Jersey Mike's Subs

My son worked at this Jersey Mike’s location on Dogwood in Milton. From his very first paycheck, the manager Abby misspelled his last name. He immediately pointed it out, but nothing was corrected. His second paycheck came in with the same mistake, and he still hasn’t received a corrected check for the first one.

Instead of fixing the error, Abby told him “the bank will still cash it.” That is not an acceptable solution. Not every employee has a banking relationship, and even if they did, Florida law requires wages to be paid timely, in full, and in the employee’s proper legal name. Under Florida Statute §448.08, employees have a right to recover unpaid wages. Additionally, under the Fair Labor Standards Act (29 U.S.C. §206 & §216), employers are required to properly pay wages earned, and failing to issue a check in the employee’s legal name does not satisfy this requirement. A paycheck issued in the wrong name is not properly issued and creates unnecessary barriers for the employee to receive the wages they’ve already earned.

To make matters worse, my son later spoke to someone higher up, and they actually backed up Abby’s stance that he should just go attempt to cash two checks issued in the wrong name. Instead of correcting the error and sparing him the wasted time and embarrassment, Jersey Mike’s representatives chose not to take responsibility and left him in limbo.

As a small business owner myself, I know firsthand that your employees’ livelihood depends on you being diligent and responsible. Pay is not optional, and employees should never be left in limbo or forced to “try their luck” at a bank because management refuses to fix a mistake. Anyone who is not willing to take immediate responsibility for ensuring their workers are properly paid should not be in a management position.

This situation shows a lack of care for the team and a disregard for both legal obligations and basic respect for employees. Workers deserve better. My dollar will not be spent at businesses that conduct themselves this way.

My car broke down in front of their facility I was having to call a tow truck and to get the number using my insurance information was very difficult. Their staff helped me tremendously by looking up addresses for me and phone numbers they were absolutely awesome I will come back and eat there but their staff is absolutely great!
