This merchant charged a 4% surcharge on my DEBIT card. I advised them that it is against visa policy and ILLEGAL in the state of Texas to charge surcharges on debit cards. They very aggressively argued with me, even though I told them I wasn’t trying to argue, only informing them. I also gave a negative review online and posted the law as well as VISA policy regarding surcharges. My receipt does state that the added $0.88 was a “Service Charge 4%”.

This establishment is ILLEGALLY charging fees. Visa Debit cards are not allowed to be charged any surcharges (per visa policy).
Businesses can only charge fees on credit cards, not debit cards. While the food and service is always great, they’re overcharging people. Texas law only allows very specific credit card surcharges.
My total was $21.00 (1 fresa con crema at $7 & 2 banana splits at $7 ea), somehow she added an additional $0.25 fee plus a 4% service charge?? I paid with a DEBIT card. Additionally, I asked for an itemized receipt and was told they didn’t have the ability to do that.
I informed the woman and she didn’t correct anything. I’m turning the business in to 2 places- Visa and Texas Attorney General’s Office and I suggest you do the same! (This goes for ALL businesses who illegally charge these fees).
